1 Introduction
These general terms and conditions (hereinafter "GTC") of nanura GmbH (hereinafter "nanura") apply to all services and products (hereinafter "products") of the nanura online shop. All other services are regulated in separate terms and conditions. Every natural and legal person becomes a customer at nanura designated, which maintains business relations with nanura .
2. What do the GTC apply to (scope of application)
The terms and conditions apply to all products or services that nanura offers in the online shop. Sale and delivery are only carried out according to the present General Terms and Conditions. Conditions of the customer that are contrary to or deviate from these General Terms and Conditions will not be recognized unless nanura has expressly agreed to their validity in writing. 3. Services provided by nanura
nanura always strives to be innovative and up-to-date. We provide our services professionally and carefully in accordance with these General Terms and Conditions and the other contractual provisions. nanura strives to constantly offer its customers the best and most up-to-date products.
4. Pricing
Unless otherwise stated, all nanura prices include VAT, any advance recycling fees and any copyright fees.
5. No guarantee for product information and availability and guarantee information
nanura always strives to inform and educate customers about the products and services offered as best as possible. Some of this information is obtained directly from the manufacturers or suppliers and is compiled by nanura for customers in a clear and customer-friendly manner. Any information about products, services, recommendations, warranty provisions and warranty periods published by nanura is therefore without guarantee and should not be understood as an assurance. In particular, no liability can be assumed for the correctness, completeness and topicality of the information.
nanura attaches great importance to carefully maintaining the availability information and reporting it as correctly and precisely as possible. Many of the products on offer are sourced from manufacturers outside of Switzerland. However, there may be delays in delivery due to production or delivery bottlenecks or incorrect inventory data. All information on delivery times is therefore not binding and without guarantee and can change at any time and without notice. Delivery can also become completely impossible if a product can no longer be manufactured or delivered. In this case, a delivery impossibility occurs according to Section 6 of the General Terms and Conditions.
6. When is the contract concluded?
The products, services and prices published at www.[ nanura ].ch are valid as an offer (offer). However, this offer (offer) is always subject to the (dissolving) condition of an impossibility of delivery or an incorrect price indication (on the part of the manufacturer or of nanura ). This means that non-delivery may occur due to items that are no longer available. In addition, it may also be that we have not given the correct prices in the shop.
The contract is concluded as soon as the customer places his order via the online shop, in a shop, by telephone or e-mail. The arrival of the order for an online order is indicated to the customer by means of an automatically generated order confirmation by e-mail. The receipt of the automatically generated order confirmation does not contain any promise that the product is actually available or can be delivered. It merely shows the customer that the order placed has arrived at nanura and the contract has thus been concluded, which is subject to the condition subsequent of non-delivery.
If one of the above (dissolving) conditions occurs, the contract will be dissolved immediately and without the involvement of the parties. We will inform our customers immediately about such a dissolution. If the product has already been handed over, ownership automatically reverts to nanura and the customer is obliged to return the goods (with nanura repaying the price paid). If the product has not yet been handed over, the customer is neither obliged to pay the purchase price nor to accept it. As a result of such a contract termination, nanura is not obliged to make a replacement delivery.
7. What payment terms do we offer?
The customer undertakes to pay using the payment options provided by nanura . At the moment you can only pay with the supported debit and credit cards that are visible in the shopping cart checkout. After the purchase, the customer is sent a receipt by e-mail and the order is put together at nanura and prepared for dispatch.
Products delivered to the customer remain the property of nanura until the purchase price has been paid in full. The customer grants nanura the right to enter any retention of title in the retention of title register.
8. What happens in the event of late payment?
If the customer does not meet his payment obligations in whole or in part, all outstanding amounts that are owed are due immediately. nanura reserves the right to suspend all deliveries. In addition, nanura reserves the right to withdraw from the affected orders. This termination of the contract comes into effect automatically and without prior notice eight days after nanura has unsuccessfully sent the customer a request for payment.
nanura can remove the "Invoice" payment option at any time for customers who are aware of a default in payment or other circumstances that reduce their creditworthiness. In this case, such customers can only place orders with the credit card payment option.
9. Cancellation and Termination of Contract
Customer orders from nanura are binding in accordance with Section 6 of the General Terms and Conditions. The customer is then obliged to accept the ordered service/products. Subsequent changes and cancellations are possible in certain cases, but are at the discretion of nanura and can be associated with operational costs (industrial compensation of up to 30% of the order value or at least CHF 50.00, as well as the depreciation of the products since they were ordered).
If the customer does not accept the products within two weeks despite the obligation to purchase, nanura can terminate the contract and charge for the operating costs in accordance with Section 9 of the General Terms and Conditions.
If nanura is able to deliver in accordance with Section 6 of the General Terms and Conditions, the customer has the right to withdraw at the earliest four weeks after the agreed delivery date. In the event of cancellation due to non-delivery, nanura will reimburse the customer for amounts already paid in advance.
10. Exchanges and Returns
Returnable items can be returned to nanura within 30 days of the invoice date. Attention: The goods must be returned new, unused, unopened and in their original condition including label(s) and original packaging as well as the invoice. The returns can be sent back to the post office. The costs for the return are borne by the customer.

The right of return is excluded for the following products:
- Articles from special campaigns (e.g. sale, special sales)
- Items marked "this item is non-returnable"
If the above products are defective, incomplete or in poor condition, they can be returned. In this case, nanura will endeavor to find an equivalent replacement. If this is not possible, the money already paid will be refunded. The exchange and return of products are generally not possible. An exchange or return can only be made in exceptional cases and after consultation with nanura . The price basis for all returns and exchanges is always the current price that is valid on the day of the return or exchange. Products that have been specially ordered for the customer, as well as individually configured products, cannot be returned or exchanged at all.
11. Deliveries from nanura
Delivered products must be checked immediately for correctness, completeness and integrity. If errors or damage (visible or not) occur, the customer must report these to nanura immediately after they are discovered, but no later than 7 calendar days after receipt of the shipment or acceptance of the products. For further claims processing, the consignment must be kept in the delivery condition and the product must not be used.
12. Returned Goods for Repair
If the customer wants to return goods to nanura , this will be done at the customer's expense and risk to the return location specified by nanura . The products are to be sent with all accessories and professionally packed and insured. A detailed description of the fault or defect and a copy of the invoice must be enclosed with the return.
13. What service and guarantee does nanura provide?
Since nanura manufactures the products sold itself, the shelf life stated on the product or in the description applies.
Products marked as "test model" in the shop are demonstration products. This means that these products have been tested by nanura or its experts. These products may have slight visual imperfections, which are sold at a discounted price. These optical defects are excluded from the guarantee. With regard to functionality and usability, the manufacturer's normal warranty conditions apply.
Warranty replacement or warranty repair does not extend the original warranty period.
For the rest, the statutory warranty provisions according to Art. 197 ff. OR apply. The customer is entitled to rectification, but not to rescission or reduction.
14. Redeeming Discount Vouchers
nanura can issue so-called discount vouchers. These vouchers may require a minimum order value. This can be seen on the discount voucher itself. Discount vouchers cannot be accumulated. This means that only one voucher can be redeemed per purchase.
16. Liability
Claims for damages from non-delivery, from breach of contract, from culpa in contrahendo and from tort are completely excluded, unless intentional or grossly negligent action is involved, against nanura and against nanura's vicarious agents.
ATTENTION: Any liability for indirect damage and consequential damage resulting from the use, malfunction or failure of goods delivered by nanura is excluded.

We are pleased that you are interested in our products. Protecting your privacy is very important to us. Below we inform you in detail about the handling of your data.
Collection, processing and use of personal data
You can visit our site without providing any personal information. We only store access data without personal reference, such as the name of your internet service provider, the page from which you are visiting us or the name of the requested file. These data are evaluated exclusively to improve our offer and do not allow any conclusions to be drawn about your person. Google Analytics can be used for this. You have the option of preventing this analysis by using special software.
Personal data is only collected if you voluntarily provide it to us when ordering goods or registering for our newsletter. Without your separate consent, we only use the data you provide to fulfill and process your order. Once the contract has been completed and the purchase price has been paid in full, your data will be blocked for further use and deleted once the tax and commercial law regulations have expired, unless you have expressly consented to the further use of your data.
